This happened in a local school district in my area.

this is just more than dumb.....people are calling for the teachers head.....I say the kids parents should get the other parents of kids in the class to all wear Yankees Tshirts.....drive the guy insane

This is indeed ridiculous... as much as this is:

If I were the parent of the child, I would be upset about my son's feelings and how this incident may continue to affect him in the future - other kids making fun, teachers stuck in a him-vs-us mode, etc... his 1st amendment rights, as important as they conceptually are, would never have even entered my mind... unless I wanted to sue the school and make some dough out of this, I suppose.

I live right near the NY/MA border. I find the whole Yankees/Sox "thing" incredibly stupid and exhausting. I've witnessed family members in heated arguments over which team logo their infant will wear. It's an f'n game!
The result will be determined by the teacher's tenure status. If he has it, he'll get a warning, if not, goodbye.
Parents probably sue for emotional trama, etc... and town settles out of court, sealed settlement, I'd guess $25,000 nuisance value.

That happened to me when I was a kid. I grew up in Ann Arbor, Michigan where University of Michigan is. My father went to Michigan State so I used to wear State shirts to school all the time. I had a teacher refuse to let me take a test until I turned my shirt inside out. My mom went in to school the next day and ripped the teacher a new ass hole right in front of the whole class. I also got thrown out of music class one day becuase I refused to sing the UofM fight song. That time the principle called my mom and appologised before she got to the teacher. My friends used to buy me UofM shirts for my birthday's and say I had to wear them because they were presents, so I would wear them to mow the lawn and used them to wash cars with, anything to make them filthy.

As a teacher (and coach) The rivalry thing in sports if handled with sound judgement and humor can actually be a positive part of interaction with kids. When it becomes more important then teaching/learning, etc. Then something is out of whack.

IMO, of course:
The teachers should never be the standard bearers of the school dress code, period. That's the job of the principal, or the assistant principal/disciplinarian.
Teachers should be pleased that the kids show up, and then get on with the task of teaching.
Anybody remember that episode of The Wonder Years, when Kevin started high school and he had a shell-shocked 'Nam vet for a teacher? The guy wouldn't let kids tear pages out of spiral notebooks, because the sound gave him "flashbacks!"

Great idea. I think the Yankees PR people should be all over this opportunity. Send the shirts. And send Jeter there for career day. :boxer
Not a big deal though. Write him up, put a letter in his file, and move on.

I agree with enocaster, "exhausting" is the perferct word for this and actually all 'fanatical' sports team devotion.
I also agree with it not being lawsuit worthy, but the kid was then ridiculed by his classmates. Kids can be ruthless. I'd be one PO'd Daddy.

This may have been a (badly thought out) joke or gentle teasing that turned out badly. Hopefully that's all it was.
What's so amazing is that this sort of thing causes such a ruckus at a time when other instances of blantant indoctrination occurring in schools go unchallanged. Forum rules.....:tapedshut

Absolutely. It can build a positive personal relationship outside of purely academic studies.
I have Eagles season tickets and a helmet on my desk and my kids take great pleasure in busting me on Monday mornings when they play badly. And I can give them "the look" when their team blows one. I can talk football with the kids who are into it.
I have noticed over the years that the kids that I can build an out-of-class relationship with (over anything**) respond much better in class. Once we have that relationship, they don't want to disappoint me.
** another great topic is guitars. On half days and days before vacation, I'll bring in one of my guitars and let the kids that play take turns playing it in front of their friends. It lets them play (in most cases) a better instrument than they have access to and show off a bit in front of their friends at something that's not normally acknowledged. Plus, it's not a bad thing to be known as "the teacher who's pretty good on guitar".
The teacher in the story is an idiot, but I don't think bad judgment is a firing offense in this case. As said earlier, keep it in perspective.

I had a jr high history teacher that used a cuss can: money out if we cussed, money in if he did. It was a little thing, but it kept us in line. And he made sure there was enough in there for everyone's lunch on the day he took us to the local Marine base to help with the Toys For Tots.

I think the bottom line here is the teacher was being a prick......he has RedSox stuff all over his classroom and singled out this one kid......no matter how much money he makes......I can see this kid and his parents on the Today Show and sitting front row behind home plate at a upcoming playoff game....courtesy of the Yankees......but a freedom of speech issue? Do 9 year olds have freedom of speech in 4th grade?

This story is local to me as well. My son went to this school six years ago but never had him as a teacher. I feel the teacher was in the wrong, probably not enough to justify terminating him, but something should be done to correct the situation.

Another question would be, if an adult teacher can force kids to turn their shirt inside out because they didn't like the sports team on the shirt and not pay any consequences, how is that adult going to make it in the real world?
It's amazing what adults will do to children when the childs parent isn't present. If that child's parent was present would that teacher still have attempted to do that?
If I was the parent I would take my child to school with me and make that teacher turn his shirt inside out. That way the child could learn that you have to be responsible for your actions.

I asked a friend, who is a longer-time Sox fan than I am, why "Yankees suck" when they are obviously a force to be reckoned with 98% of the time.
He said "because they suck!!!!!!!!!"
I think the rivalry is fun, and it's not the end of my world when either team does anything...I understand the whole tribal thing, though, and I know why Yankees fans chant "Red Sox suck!"...same reason Red Sox fans yell "Yankees suck!" It doesn't mean shite at the end of the day. These two teams have been +/- evenly matched for a long time.
That said, this teacher took it too far. A teacher here was fired for duct taping a students mouth shut, y'know, as a joke...you have to be careful how far you take a joke these days, it used to earn you a black eye from a parent, now it gets you a lawsuit...

Noooooo!!!! Teachers do not on average make anywhere near $70,000 a year. Maybe in Brooklyn, teaching at a public school where the cost of living is sky high, and teachers with a Masters are in crazy high demand. Most teachers make more like $35,000 a year. Ones with Masters degrees make marginally more. I don't know a single teacher, even those that have taught for 30+ years, who even sniff $70,000. If you live in California, Chicago, New York City, etc. the average teaching salary is higher as it reflects the higher cost of living. Even in that case, you're still only looking at maybe $45,000 a year on average.
