Yeah, I think most places have "Jail" as an option way before the max in the poll.

Yup! You beat me to it.

Just because someone doesn't have a license doesn't mean they won't drive around drunk.

I picked 2 myself but a permanent ban is too much in my book. I'm sure there are people who had drinking problems in their 20's, got nailed a couple of times and are stone sober 20 years after the fact.

Permanent ban after the second offense. If you get one DUI, you get a chance to learn from the mistake. Do it again, and you're out. Driving a car is a privilege, not a right.

I chose 3 because the legal limit for intoxication is so low that there is a real chance that you could be legally impaired after one or two beers with dinner (depending of course on elapsed time, weight, etc). I guess we're all also assuming that there are NO additional charges like personal injury or property damage, just a DUI.

Another area where it seems the system breaks down is with under-age drunk driving. How does under-age drinking factor in?

I'm not trolling, just wondering if anybody feels that there should be leniency because the impaired operator was under the legal drinking age? Or if the penalties should be MORE strict for those individuals?

pretty sure something needs to be addressed with driving period... stopped at a major intersection this morning on my way to work and I look around...maybe 20 cars immediately around me...EVERYSINGLE PERSON was on their phones... crossed a dude yesterday on the highway both hands on a gas bill reading it while going 65mph on the highway...

DUI first one, huge fine, second one no license and jail time... too much of an opportunity to ruin multiple peoples lives.

My best friend was killed by a drunk driver in Maryland. The guy who hit him was on probation for a previous DWI/Vehicular Homicide. In my opinion the drinking & driving laws are way too lenient. People who drive while intoxicated should get mandatory jail time for committing a felony after the first offense and should permanently lose their driver’s license, with no possibility of ever getting it back. People who are guilty of vehicular homicide while driving intoxicated should get life in prison with no possibility of parole. I have zero tolerance for anyone who drives while impaired by alcohol or drugs, regardless of the circumstances.

I was in court one day, Judge Steve Duczer I think it was, and some fellah was in the room there who'd been summoned by the Court, so the fellah dropped in on his way to work. Looked relaxed.

Before we could meet with the Judge, he had to handle some routine stuff.

Seems this guy had entered a plea bargain a while back, for a DWI, then some time later he got busted again. Well the second time he entered a plea under article 894 and he was asked, did he have any previous and he said "no".

You should have seen the look on this guy's face when they shackled and handcuffed him right there in the court and hustled him off to prison.

We're extremely lax here in Louisiana. By the time a driver gets caught, he's been allowed to slide many, many times. It is kinda hairy, frankly, going out on Friday and Saturday nights because of this. I know of too many victims.

The real question is, to me, how many slides inbetween the arrests? It changes the answer you give.

A simple OUI is WAY different than vehicular homicide under the influence, I agree that if you kill somebody (or even cause serious injury) you should at the very LEAST lose your license for the rest of your life.

I also had my best friend killed by a drunk driver 33 years ago.

Here in Indy about 10 or 12 years ago, there was a guy that had received his 17th DUI. I might be off by 1 or 2, but it was definitely over 15. There were a series of articles on it and he ended up being sentenced to 18 months in jail though I suspect he was out in less than a year. At various points, he'd had his license suspended for 6 months, 12 months etc...

Thankfully he'd never hurt anybody but that's way out of control. I'm an ardent 'never drink and driver' but I'll even give someone the benefit of the doubt once for sure... maybe twice. Three times or more and regardless of what you otherwise contribute to society, you should be in jail. Other than a minor stepping stone, I don't see how a permanent license ban would be effective at all. A person is either going to learn from being busted, learn from having a near miss or learn from having a 6 month suspension.
