We didn't sue when it happened to us. They detained my mother and me once when I was 4 years old. They claimed she had put diet pills in her purse. They separated us and questioned her behind closed doors for more than an hour, while some stupid store employee sat with me. I remember crying the whole time...

Having worked in retail AP, I now understand that's a total recipe for a lawsuit.

Imagine it's your 5yr old, and somebody just walks up, grabs him and hauls him back into the shop crying and scared - what would you do ?

You're supposed to roll over and take it, I suppose.

Why the whole matter wasn't dropped when the mother showed the receipt to store personnel, I don't know. I do know the store won't likely make the same mistake again.

It says that both mother & son finished shopping and an employee accused him of stealing and took him by the hand. Overprotective parents with knee-jerk reactions like this are idiots. What kind of message is this mother showing her son? "Everytime somebody makes a minor mistake, sue their ass?"

Actually, I can think of a few other ways of dealing with this situation that fall in between "roll over and take it" and "sue your ass".

Oh yeah. The 6-year old is now scarred for life.

He wasn't harmed, killed, mutilated, or anything. Somebody took him by the hand. Oh no!!!! Kids that age are scared easily and cry just as easily. Are you going to sue everybody that ever scared or made your kid cry? Read my 2 previous posts.

I swear, some of the responses here are mind-boggling.

read the other reports please - "The Circuit Civil Court also heard that the action of the shop assistant in grabbing the boy's arm amounted to false imprisonment and assault."

I'd be pretty pissed if some mouth breathing clerk grabbed my kid and tried to haul her away.

They might have grounds for an assault counter suit!
