Screwed On eBay Uni Vibe

I just bought an old Uni Vibe, and not only does it not work, it's clearly not the unit pictured in the auction. The guy says he has four, and that his daughter may have shipped the wrong one.

The auction states no returns, but I think this is over the line.

Should I have it looked at, and ask the seller to pay for repair, or demand my money back, or turn it over to eBay with their buyer protection business.

I think this is clearly fraud, because the unit I received is not the unit in the picture. There are way more scratches and there are many screws missing, like all four screws on the face plate of the unit.

The seller is being shitty, saying it worked when he shipped it, and that he accepts no returns, too bad, get screwed.

Advice?

For better or for worse, no returns holds no water with eBay. File a complaint and I'm sure you'll get your $ back upon return of the pedal.

If the unit was DOA, and not as pictured you are entitled to a full refund under ebay policy.

He should have insured the item to protect himself from damage in shipping.

Sellers are required to accept returns if they ship you something that is not as advertised, it doesn't matter if they state "no returns accepted"

Looks like he sold a dead effect before, judging by his feedback. If you got the wrong unit, and he won't make it right, this is fraud, bait and switch. Might even be illegal. I would contact ebay, and go after this guy, it smells bad.

That is not acceptable especially if the unit is not the one pictured and the sale was for that unit that is clear breach of terms of sale. I would insist on that point with him and see what gives. If he is still a problem then file a complaint with ebay and get a tech to check to see whats wrong with the unit (if indeed the unit worked when he sent it then at most a wire may have disconnected or there should be some evidence of shipping damage, if not he is BSing you). If there isn't any shipping damage then leave negative feedback and get a lawyer. Its annoying to deal with sellers who are jokers

Let me be clear about this for everyone - if you use Paypal YOU HAVE A RETURN POLICY. It doesn't matter to eBay/PP that you say you don't. PP and ebay afford every customer the right to return.

OP - pack well, insure, return and get a confirmation. Then challenge the charge. You'll win. If you don't, PM me, and I'll make sure that you do.

File a complaint, once ebay tells you to you send it back with a tracking number, once ebay gets notice from tracking that the seller has gotten it back, you'll get your cash back.

Even if he was telling the truth that his daughter sent the wrong one, he's still a terrible seller for being so careless, especially on a $1000 item. Obviously he owes it to you to replace it with the pictured unit.

Either way, I hope that guy is selling off his 4 Univibes to actually work on his playing a bit.

Contact Paypal immediately.
Be sure to ask them if they'd like to see the email you rec'd from the seller stating his daughter might have sent the wrong one, and ask if they'd like comparison pictures to prove this.

They probably won't care, and advise you to ship it back and contact them once it has been returned.
But..they may not tell you, and IIRC this is IMPORTANT....you must ship it back SIGNATURE CONFIRMATION.
Verify if you want, but don't skimp a few bucks and get screwed out of everything.

AND be sure to leave negative feedback!

Another reason why I only deal with individuals who have 100% feedback. It may make finding a specific pedal a tad more difficult; however, I feel far more comfortable making the purchase. I'm sorry to hear about your burden and wish you all the best in regards to having the unit repaired / having your money returned.

one more reason I like to use my visa when doing paypal- I had paypal deny my claim one time. It was a $100 item, seller said new in box, blah blah. Got it and the wires were all cut and the power supply was cut and it didn't work at all. I provided pictures of what I recieved. The seller responded by saying I was just trying to get a discount from him after the fact. The day paypal denied my claim I called Capital One and I had my money back in a few days. I have no clue if Paypal made him pay it back or not, I sure hope so.

No returns is not the same as wrong item. Contact the seller and say your sending it back and notifying paypal. He can either send you the right one or refund your money. Ball is in his court.

Paypal can still take the money out of your paypal account, bank account, or credit card if they want, so not sure how well that would work. But it sounds like a nice way to get an added layer of protection.
