So just an update on this-

the guy just went away. After I said fine, send it back, insured at your expense, he just backed off. I think he is just a low-level scammer that tries to threaten people into refunding some money, he probably does it often. No way he wanted to go out of pocket and pay to ship and insure the instrument.

So, a lot of stress all for nothing, but at least it's a non-issue now.

No, he kept the guitar, after all that. Never heard from him again once it became clear he was going to have to return it on his dime, or go away.

His claims were totally baseless, the guitar was mint.

Just to put my 2 cents in here.

The fact you called paypal (ebay customer service would have worked as well) and told them politely your side of it probably made all the difference. They see/deal with this sort of stuff every day.

If you list it as "new (other)", that is different then "new" and different then "used".

I now use the word "excellent" , rather then mint, even if I consider it mint. different definition (but gives me more leeway against people like you are dealing with here) .

It is very important to contact with buyers/sellers through ebay messaging, that way ebay can see your messages (and hence your attempts to resolve an issue). Never talk by phone-just not worth it.

One last point, i think is important. I do not think you can just close your accounts before these cases are resolved. You are in legal contracts. If the case was decided against you, I would think ebay/paypal would come after you, but honestly I am not sure about this.
I mean , to get a paypal acoount, you need to give them a bank account and a credit card. (am i wrong here??)

I think you played it well, You stood your ground. You personally talked with paypal/ebay customer support. They essentially called his bluff. lots of lessons learned, peace mike

Guitar Josh is the one who helped me and told me to call paypal direct when I had an ebay problem. That ended all of the BS in my case.

I'm having an issue with Amplifiedparts.com that I'd like to share. I'm from Brazil and I was very impressed with the looks and variety of the store. So I decided to place my first order. Since it was a small order, I chose First Class Mail International, which doesn't provide tracking number.

A month passed and the order hasn't arrived. So I decided to re-order the products, with a few more items, because I didn't expect the problem to be with the store. I though that the order got lost or something. So this time I chose Express Mail. I received the shipment confirmation, but to my surprise, they didn't send me the tracking number.

For three days now, I've been sending emails to every form of contact they provide on their website, sent messages through their Twitter account and Facebook page, requesting the tracking number, so I can be sure that they did ship my order. But I have not received any answer so far.

The two orders total almost US$ 300! I'll escalate the problem to Pay Pal buyer protection if don't hear from them soon, but I'm very concerned that I'll never get my products or my money back.

I agree escalate and file a claim with credit card company if that is what you used to pay.
