Unless that's very much the same as a Tom Waits song I haven't heard, I really can't see the point of the thread.
It seems like a mash up trying to relate to the style of Waits, The Black Keys and probably a bunch of other fuzzy, minimal artists out there.
I'd actually be disappointed if I heard that on a Tom Waits record!
Not a song ripoff, no. I guess it just sounds to me like an impersonation. I guess it's been done before. Never mind......

I do hear what you heard and I'm sure that there was an ad guy that said, "Hey, I need a song that sound like this ________."
I guess it sounded more like a mashup of a couple of different current styles rather than a straight Wait's rip to me.
They're definitely going for something that we know.

Funny, though, I just read Waits' wiki page, and apparently he has sued and won against commercials using similar songs/style before. I'm not familiar with those so I'm not saying it's the same situation.
I can hear some waits in there, but like rhino said it's a mix. If they had used a guttural growly voice it would have been too close and I would guess the Armstrong family would have to be notified too. ha. but I do hear a strong waits' presence there like you
It does sound like it could have fit on Bone Machine and Wait's has previously successfully sued companies for ripping of his "sound image" so payment and/or a lawsuit is not out of the question. Although in some of those previous cases the company tried to hire Waits first and that may have given him more legal traction.
I hear Howlin' Wolf is suing Tom for stealing his schtick.
Same with Louis Armstrong.
In that particular instance, the company had approached Tom Waits about using his music and he declined. That made the lawsuit pretty much a slam dunk.
