Looking for a New Orleans small claims lawyer

    10 months ago my son's parking garage's valet service in New Orleans totaled his car, and despite stating in writing that they would pay him X amount, they have not and have been blowing him off for months.

    So, he's looking for a lawyer in New Orleans who will help with a demand letter and filing in small claims court within the next 7 weeks, before a year passes and he can't file anymore.

    Does anyone know a lawyer in New Orleans who might help? The settlement amount is likely below $3k so he's been having a hard time finding someone to help.

    Small claims is a total waste of time. You may win the case, but that's as far as it goes. Depends a lot on the State.

    Someone ran a light and smashed into my car in California. I won the case, could not collect.
    Someone sold me a rebuilt motor in Texas. The motor was junk. I won the case, could not collect.

    This is a corporation with assets though. It's not an uninsured motorist. I would assume if he wins the case, he will be able to collect.

    Isn't the point of small claims to not have a lawyer? Sounds like a pretty solid case, especially if he has their promises in writing.

    You can download demand letters and the filing fees are only a hundred bucks or so IIRC. No lawyer wants anything to do with a $3K case they might not even win and I can't blame them. In fact in California you can't even have an attorney represent you in small claims.

    One issue is that he's no longer in N.O. Is it possible to file in absentia ?

    I thought that "small claims" court meant "no lawyers"...

    I agree that it's iffy.

    Only time I tried it the judge tried to play "Solomon" and split things down the middle because they were too lazy to investigate the facts and the law...

    It also can be tough to collect any judgement, like Tweed said.

    I think he's hopeful that a threatening letter from an attorney will prompt a payment prior to having to go to court.

    Probably any lawyer can do that, but it's probably going to cost a couple hundred bucks for the letter.

    Is there a police report?

    Did you contact your insurance company?

    Did you get their insurance info?

    They have to be bonded and insured. Did you get their bond info?

    Small claims=no lawyer. Get the above and go from there.

    Thinking about it further, contact the Better Business Bureau - immediately - and send them everything you have to document the claim - and the brush off - that alone might get you the check.

    The Filing Fee for a small claim is nearly as high as the regular jurisdiction courts. When you find out what it is going to be, you will be very angry.

    The problem here is lawyers need Vigorish or a Fund out of which to be paid. They're expected to devote so much careful attention to what they'll do for your son, that if you assigned fair going rate to it, it will consume most of the remaining money at stake.

    People are of the mistaken belief that things are "Normal" in New Orleans. That's laughably false. This garage is playing this game precisely because they know what a bind your son is in, trying to collect.

    I'm thinking about all the young women who are thinking about going to Mardi Gras, who are going to end up being raped and more. The place is a mess; you go there strictly against my advice, at your own risk.

    I disagree with Boris on the state of New Orleans - in many ways the city post-Katrina is better than ever - crime is up although murder is down.

    As always, be careful out there.
