What would you do...sale went wrong.

I bought a PRS on eBay a month ago, and paid at once 3000 US$ the guitar via PayPal.

I live in France, the seller ( a big music store with 99,8% positive evaluation) is canadian, and sells a lot overseas. As it was my 45th birthday, I asked the seller if he could send the guitar fast, he said he was doing the necessary.

9 days later, the tracking number he gave me was still not working, so I contacted him again. He told me he was sorry but that he had to delay expedition for some (obscure) reason, and again that he was doing the necessary fast.

On day 17 after my payment (I paid 200 us$ for a 8 days delivery), I receive a package at home; I open it and find a '66 Tele in bad shape, nothing to do with the PRS.

Seller contacts me and say that there was a problem with TNT: my guitar is in Italy, and I have the Tele of an Italian client....

I do the necessary, the day after TNT picks up the Tele at my home.

On day 25, still no news from the seller and the PRS, so I contacted the seller to tell him that I don't want the guitar anymore, that he contacts TNT so the guitar goes back directly from Italy to Canada, and that I want my money back as he offered returns.

Seller is okay but asks me to pay the shipping back.

What would you have done in this particulary complicated situation ? Am I a moron for not being patient and not wanting the PRS anymore ?

Nothing wrong with canceling, and the seller should wear all fees. This sounds like a major stuff up on their part.

You should get every penny back. You should not be out anything. He messed up, not you.

as already stated ,seller eats it . And no I wouldn't want the prs after its been all over the world . No telling what shape it would be in when you got it and then you would be responsible for return shipping

No kidding. Out them out OP, and whatever you do dont settle on paying return shipping.

I don't think it's too hard to figure out. I searched completed listings of Santanas, and OP already told us where the store is. Click on a few... the Feedback score will let you know you've found the spot.

How did you pay? If by credit card you may have a lot of leverage-at least you would with a US credit card. I believe the laws regarding credit cards may be more favorable to the consumer in the United States than in the EU, at least as regards disputed charges.

If you haven't already, open a dispute with ebay. Communicate with the seller only through ebay because that's the only communication ebay will use to decide the dispute.

Don't out the seller on TGP, it's against the rules. File a complaint with PAYPAL. The seller messed up, badly, you shouldn't pay for his mistake.

Ok, here are the latest news.

I was very angry, but the guitar finally arrived on Sat 10/26 ( I paid on 09/21). Four days ago, I opened a dispute with eBay.

My first intention was to keep it boxed, send it back to Canada and have a refund.

I've wanted a PRS Santana for a long time, I first tried one 15 years ago and always dreamed to have one.

So my curiosity killed me, I opened the box this morning. What a great guitar. I had a PRS hollowbody a few years ago that I didn't like, but this one is a hell of a guitar: very comfortable, and really, really great sounding. She's also truly beautiful in Eriza Verde.

I'll keep it. I'm sending a word to the seller, who, even if he tried his best to find a solution and was ok for the refund, never gave me an explanation for the initial 9-days delay before sending the guitar.

I don't want to give him a negative evaluation (nor a positive), he kept telling me that it was TNT Express that fu***d up.

Glad it ends well and that I finally got a fantastic guitar.

Thanks to everybody here for your precious advices.
